Earth-40 is one of fifty-one divergent realities that branched from the core New Earth reality during the recreation of the Multiverse shortly following the events of Infinite Crisis.
The Earth of this reality contains characters from the Justice Society of America, but portrays them as covert government operatives in a World War II-era setting, rather than their traditional portrayal as superheroes fighting criminals.
